COMPENSATION
New York created the Workers’ Compensation Law in 1914 as a compromise between workers and employers. As part of the compromise, workers gave up the right to sue the employers for negligence that caused an injury. In return, workers were promised payment for lost wages and medical bills for work-related injuries, without regard to fault. An injured worker’s entitlement to compensation and the amount of compensation are the same, regardless of whether the accident was the fault of the worker, the employer or someone else. INJURY
The law provides a number of different ways for people to seek a recovery for personal injuries. The most common method is to bring a lawsuit for “negligence” when someone else was partly or entirely at fault for an accident that resulted in an injury. Some examples of a negligence lawsuit would be a car accident, a slip and fall, or a trip and fall. There are often laws or regulations that create standards of responsibility, which makes people liable for money damages if they do not follow the rules. DISABILITY
Disability insurance coverage was added to the Social Security Act by Congress in 1956. It provides disability benefits to certain workers under age 65 who are unable to work (referred to as “substantial gainful activity”) for a continuous period of twelve months or more. To receive benefits, you must first prove that you are “insured”. To be insured, you must have worked a sufficient number of years and paid sufficient social security taxes. LONG-TERM
DISABILITY
You thought you were covered for catastrophic illness when your company benefits included a Long Term Disability (LTD) Insurance Plan, or you went out and got one on your own. Then when you became disabled and you put in the claim and do everything the Insurance Company told you to do. You thought you were covered, but the insurance company sends you a letter denying the claim, or pays you for a little while, and then sends a letter telling you that you have been terminated! LONGSHORE
CASES
Enacted in 1927, the Longshore and Harbor Workers’ Compensation Act compensates for lost wages, medical benefits, and rehabilitation services to longshore, harbor and other maritime workers who are injured during their employment or who contract an occupational disease related to employment.
