On March 7, 2020 Governor Andrew M. Cuomo signed Executive Order 202 declaring a disaster emergency in the State of New York due to the COVID-19 pandemic.
Then, on March 18, 2020 Governor Cuomo signed Executive Order 202.6 creating in-person restrictions for all non-essential businesses. A “PAUSE” order was issued for all of New York State. Additionally, the Governor identified key businesses within the State of New York that are deemed essential. Unlike other companies, these businesses and their employees are allowed to perform in-person services.
Who is an essential employee? An essential employee is someone that performs work involving the safety of human life and the protection of property. Under Governor Cuomo’s executive order that would include employees in the health care industry, emergency personnel, security personnel, pharmacy employees, bank employees, transit workers, airport employees, courier employees, food and agricultural workers (including restaurant employees) to name just a few.
Essential workers are clearly subject to an increased hazard of contracting COVID-19 as a result of in-person contact. if you were exposed and contracted COVID-19 while performing your job responsibilities You may be afforded lost wages and medical benefits under the New York State Workers’ Compensation Law.
